Book 42: Distribution of Water · Hadith 27

أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ، حَدَّثَنَا اللَّيْثُ، حَدَّثَنِي ابْنُ شِهَابٍ، عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ، عَنْ أَبِيهِ ـ رضى الله عنه ـ قَالَ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ "‏ مَنِ ابْتَاعَ نَخْلاً بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلْبَائِعِ، إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ، وَمَنِ ابْتَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلَّذِي بَاعَهُ إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ ‏"‏‏.‏ وَعَنْ مَالِكٍ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ عَنْ عُمَرَ فِي الْعَبْدِ‏.‏

Narrated 'Abdullah (ra): I heard the Messenger of Allah (ﷺ) say, "If somebody buys date-palms after they have been pollinated, the fruits will belong to the seller unless the buyer stipulates the contrary. If somebody buys a slave having some property, the property will belong to the seller unless the buyer stipulate that it should belong to him

Abdullah (رضی اللہ عنہ) bataate hain: Maine Allah ke Rasool ko farmate suna: "Agar koi khajoor ke darakht unke pollinated hone ke baad khareedta hai, phal bechne wale ke honge siwaye jab khareedar iske ulta shart rakhe. Agar koi maal wala gulaam khareedta hai, maal bechne wale ka hoga siwaye jab khareedar shart rakhe ke woh uska hoga."
