Sahih al-Bukhari 4552

Hadith text

Narrated Ibn Abu Mulaika:Two women were stitching shoes in a house or a room. Then one of them came out with an awl driven into her hand, and she sued the other for it. The case was brought before Ibn `Abbas, Ibn `Abbas said, "Allah's Messenger (ﷺ) said, 'If people were to be given what they claim (without proving their claim) the life and property of the nation would be lost.' Will you remind her (i.e. the defendant), of Allah and recite before her:--"Verily! Those who purchase a small gain at the cost of Allah's Covenant and their oaths..."(3.77) So they reminded her and she confessed. Ibn `Abbas then said, "The Prophet (ﷺ) said, 'The oath is to be taken by the defendant (in the absence of any proof against him)

Ibn Abu Mulaika bataate hain: Do auratein ek ghar ya kamre mein joote sil rahi thin. Unmein se ek suja (awl) haath mein ghusa hone ke saath baahar aayi, aur usne doosri par ilzaam lagaaya. Maamla Ibn Abbas ke paas laaya gaya. Ibn Abbas ne kaha, 'Allah ke Rasool (SAW) ne farmaya, "Agar logon ko wo sab kuch de diya jaaye jo wo (bina saboot ke) dava karein, to logon ki jaan aur maal barbaad ho jaaye." (Isliye tum) usse (yaani mulzima ko) Allah ka khauf yaad dilaao aur uske saamne ye padho: "Beshak jo log Allah ke ahd aur apni qasmon ke badle thodi si keemat kharidte hain..." (3:77)' To unhone usse yaad dilaaya aur usne iqraar kar liya. Ibn Abbas ne aage kaha, 'Nabi (SAW) ne farmaya, "Qasam mulzim (jispar ilzaam ho, jab saboot na ho) ko uthaani hoti hai."'
