Book 85: Laws of Inheritance (Al-Faraa'id) · Hadith 13
Hadith text
Narrated Huzail bin Shirahbil:Abu Musa was asked regarding (the inheritance of) a daughter, a son's daughter, and a sister. He said, "The daughter will take one-half and the sister will take one-half. If you go to Ibn Mas`ud, he will tell you the same." Ibn Mas`ud was asked and was told of Abu Musa's verdict. Ibn Mas`ud then said, "If I give the same verdict, I would stray and would not be of the rightly-guided. The verdict I will give in this case, will be the same as the Prophet (ﷺ) did, i.e. one-half is for daughter, and one-sixth for the son's daughter, i.e. both shares make two-thirds of the total property; and the rest is for the sister." Afterwards we cams to Abu Musa and informed him of Ibn Mas`ud's verdict, whereupon he said, "So, do not ask me for verdicts, as long as this learned man is among you
Huzail bin Shirahbil bataate hain: Abu Musa se ek beti, ek bete ki beti, aur ek behen ki (miraas mein hisse ke) baare mein pucha gaya. Unhone kaha, 'Beti ko aadha milega aur behen ko aadha milega. Agar tum Ibn Masud ke paas jaao, to wo tumhein yahi bataayenge.' Ibn Masud se pucha gaya aur unhein Abu Musa ka faisla bataya gaya. Ibn Masud ne kaha, 'Agar main bhi wahi faisla dun, to main bhatak jaunga aur seedhe raah walon mein se nahi rahoonga. Jo faisla main is maamle mein dunga, wo wahi hoga jo Nabi (SAW) ne diya tha, yaani beti ko aadha, aur bete ki beti ko chhathvaan hissa, yaani dono hisse mil kar poori jaayadaad ka do-tihaai; aur baaki behen ke liye.' Baad mein hum Abu Musa ke paas aaye aur unhein Ibn Masud ka faisla bataaya, isper unhone kaha, 'To, mujhse faisle mat maango, jab tak ye aalim aadmi tumhare beech hai.'
