Book 86: Limits and Punishments set by Allah (Hudood) · Hadith 60

حَدَّثَنَا عَاصِمُ بْنُ عَلِيٍّ، حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ، عَنِ الزُّهْرِيِّ، عَنْ عُبَيْدِ اللَّهِ، عَنْ أَبِي هُرَيْرَةَ، وَزَيْدِ بْنِ خَالِدٍ، أَنَّ رَجُلاً، مِنَ الأَعْرَابِ جَاءَ إِلَى النَّبِيِّ صلى الله عليه وسلم وَهْوَ جَالِسٌ فَقَالَ يَا رَسُولَ اللَّهِ اقْضِ بِكِتَابِ اللَّهِ‏.‏ فَقَامَ خَصْمُهُ فَقَالَ صَدَقَ اقْضِ لَهُ يَا رَسُولَ اللَّهِ بِكِتَابِ اللَّهِ، إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ، فَافْتَدَيْتُ بِمِائَةٍ مِنَ الْغَنَمِ وَوَلِيدَةٍ، ثُمَّ سَأَلْتُ أَهْلَ الْعِلْمِ، فَزَعَمُوا أَنَّ مَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ‏.‏ فَقَالَ ‏ "‏ وَالَّذِي نَفْسِي بِيَدِهِ لأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ، أَمَّا الْغَنَمُ وَالْوَلِيدَةُ فَرَدٌّ عَلَيْكَ، وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ، وَأَمَّا أَنْتَ يَا أُنَيْسُ فَاغْدُ عَلَى امْرَأَةِ هَذَا فَارْجُمْهَا ‏"‏‏.‏ فَغَدَا أُنَيْسٌ فَرَجَمَهَا‏.‏

Narrated Abu Huraira and Zaid bin Khalid:A bedouin came to the Prophet (ﷺ) while he (the Prophet) was sitting, and said, "O Allah's Messenger (ﷺ)! Give your verdict according to Allah's Laws (in our case)." Then his opponent got up and said, "He has told the truth, O Allah's Messenger (ﷺ)! Decide his case according to Allah's Laws. My son was a laborer working for this person, and he committed illegal sexual intercourse with his wife, and the people told me that my son should be stoned to death, but I offered one-hundred sheep and a slave girl as a ransom for him. Then I asked the religious learned people, and they told me that my son should be flogged with one-hundred stripes and be exiled for one year." The Prophet (ﷺ) said, "By Him in Whose Hand my soul is, I will judge you according to Allah's Laws. The sheep and the slave girl will be returned to you and your son will be flogged one-hundred stripes and be exiled for one year. And you, O Unais! Go to the wife of this man (and if she confesses), stone her to death." So Unais went in the morning and stoned her to death (after she had confessed)

Abu Huraira aur Zaid bin Khalid bataate hain: Ek badawi Nabi (SAW) ke paas aaya jabke wo baithe hue the, aur kaha, 'Aye Allah ke Rasool! Humein Allah ke Qawaanin ke mutaabik faisla dijiye.' Phir uska mukhaalif khada hua aur kaha, 'Unhone sach kaha, Aye Allah ke Rasool! Unke maamle ka faisla Allah ke Qawaanin ke mutaabik kijiye. Mera beta is shaks ka mazdoor tha, aur usne iski biwi ke saath zina kiya, aur logon ne mujhse kaha mere bete ko sangsaar kiya jaana chaahiye, magar maine sau bakriyaan aur ek launDi uske fidye mein di. Phir maine deeni aalimon se pucha, aur unhone mujhe bataaya ke mere bete ko sau kode maare jaayein aur ek saal ke liye jila-watan kiya jaaye.' Nabi (SAW) ne kaha, 'Us Zaat ki qasam jiske haath mein meri jaan hai, main tumhaare beech Allah ke Qawaanin ke mutaabik faisla dunga. Bakriyaan aur launDi tumhein wapas ki jaayengi aur tumhaare bete ko sau kode maare jaayenge aur ek saal ke liye jila-watan kiya jaayega. Aur tum, Aye Unais! Is aadmi ki biwi ke paas jaao, (aur agar wo iqbaal kare), to use sangsaar kar do.' To Unais subah gaye aur (unke iqbaal karne ke baad) use sangsaar kar diya.
