Sahih al-Bukhari 6971

Hadith text

Narrated `Aisha:Allah's Messenger (ﷺ) said, "It is essential to have the consent of a virgin (for the marriage). I said, "A virgin feels shy." The Prophet; said, "Her silence means her consent." Some people said, "If a man falls in love with an orphan slave girl or a virgin and she refuses (him) and then he makes a trick by bringing two false witnesses to testify that he has married her, and then she attains the age of puberty and agrees to marry him and the judge accepts the false witness and the husband knows that the witnesses were false ones, he may consummate his marriage

Aisha bataati hain: Allah ke Rasool (SAW) ne farmaya, 'Ek kunwaari ki raazamandi lena zaroori hai (shaadi ke liye).' Maine kaha, 'Ek kunwaari sharmindaa ho jaati hai.' Nabi (SAW) ne kaha, 'Uski khaamoshi hi uski raazamandi hai.' Kuch logon ne kaha, 'Agar koi aadmi kisi yateem launDi ya kunwaari se mohabbat kar baithe aur wo inkaar kare, aur phir wo chaal se do jhoote gawaah laaye gawaahi dene ke liye ke usne unse shaadi ki hai, aur phir wo baaligh ho jaaye aur usse shaadi karne ke liye raazi ho jaaye aur qaazi jhooti gawaahi qubool kar le aur shohar ko pata ho ke gawaah jhoote the, to wo shaadi mukammal kar sakta hai.'
