Narrated Jabir bin `Abdullah:The Prophet (ﷺ) has decreed that preemption is valid in all cases where the real estate concerned has not been divided, but if the boundaries are established and the ways are made, then there is no preemption. A man said, "Preemption is only for the neighbor," and then he makes invalid what he has confirmed. He said, "If someone wants to buy a house and being afraid that the neighbor (of the house) may buy it through preemption, he buys one share out of one hundred shares of the house and then buys the rest of the house, then the neighbor can only have the right of preemption for the first share but not for the rest of the house; and the buyer may play such a trick in this case
Jabir bin Abdullah bataate hain: Nabi (SAW) ne faisla diya ke Shufa'a (preemption ka haq) sab maamlon mein jaayez hai jahaan asal jaayadaad taqseem nahi hui hai, magar agar seemaayen (boundaries) muqarrar ho chuki hain aur raaste bana diye gaye hain, to phir Shufa'a nahi hai. Ek shaks ne kaha, 'Shufa'a sirf padosi ke liye hai,' aur phir unhone jo tasdeeq ki thi use na-jaayez qaraar de diya. Unhone kaha, 'Agar koi ghar khareedna chahta hai aur use dar hai ke padosi Shufa'a ke zariye use khareed lega, to wo ghar ke sau hisson mein se ek hissa khareedta hai, aur phir baaki ghar khareedta hai; to padosi ko sirf pehle hisse ke liye Shufa'a ka haq hoga, baaki ghar ke liye nahi; aur khareedar aisi chaal is maamle mein chal sakta hai.'
